KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 24-02-2020 Petitioner has prayed for the following reliefs: (i) issuance of direction/writ in the nature of mandamus specially respondent Nos. 3 and 4 for removal of encroachment from the Paine (public land nearby bank of canal) which is situated near the bank of canal till Plot No. 1399 which went to North end of the village and some persons/villagers encroached some of the public land and constructed their houses and apart from that the villagers/public had also encroached Gairmazarua land situated at Khata No. 95 Khesra No. 1331, Thana No. 222 of village Mahabalipur and the above mentioned lands were public land and used as Aam Rasta but due to construction made by some villagers the Aam Rasta has been obstructed.

(ii) For disposal of representation/public petition dated

Patna High Court CWJC No.3994 of 2020(2) dt.24-02-2020 2/2 18.11.2019 and 18.10.2019 whereby the villagers represented before the respondent no. 3 for removal of the illegal encroachment on the public land of the village."

After the matter was heard for some time, finding the Court not to be in favour of submission made across the bar, learned counsel for the petitioner seeks permission to approach the authorities concerned for highlighting the grievance in accordance with law.

Learned counsel for the respondents, states that any such request shall be dealt with expeditiously and in accordance with law.

Statement is taken on record.

In view of the same, the present petition stands disposed of with a direction that any such request is received from the petitioner, the same shall be dealt with in accordance with law with reasonable dispatch and not later than six months thereafter.
