NILU AGRAWAL ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor, for the State. The petitioner is languishing in judicial custody since 27.06.2016 in connection with Sahebpur Kamal P.S. Case No. 235 of 2015 for the offences alleged under Sections 366A, 120B, 504/34 of the Indian Penal Code and Sections 6/8 of the POCSO Act.
The prosecution case, as alleged by the informant, is that his 14 years old daughter, Rina Kumari has been abducted for the purposes of marriage by the petitioner and other named accused.
It has been submitted by learned counsel for the petitioner that the petitioner is innocent and has no criminal
Patna High Court Cr.Misc. No.5909 of 2017 (3) dt.22-03-2017 2/2 history and even the victim girl, who was recovered, in her statement under Section 164 Cr. P.C., has not named the petitioner.
However, learned counsel for the State submits that the petitioner is named in the FIR, hence opposes the prayer for bail.
Considering the facts and circumstances and materials on record, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional District & Sessions Judgecum- Special Judge, Begusarai in connection with Sahebpur Kamal P.S. Case No. 235/2015.
