NILU AGRAWAL ORAL ORDER 19-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner is languishing in judicial custody since 27.06.2016 in connection with Sessions Trial No. 608 of 2016 arising out of Singhia P.S. Case No. 134 of 2014 registered for the offence punishable under Sections 447, 307 and 387/34 of the Indian Penal Code.
The prosecution case is that the petitioner and one another accused, Chunnu Singh @ Akhilesh Kumar Singh fired at the informant due to non-fulfilment of demand of ransom. It has been submitted by the learned counsel for the petitioner that no injury has been caused to any one, as such, Section 307 of the Indian Penal Code is not applicable. He further submits that allegations are general and omnibus and that another
Patna High Court Cr.Misc. No.10328 of 2017 (5) dt.19-06-2017 2/2 accused with similar allegation has since been granted the privilege of bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 9832 of 2017 on 11.04.2017. He further submits that chargesheet and supplementary charge-sheet has already been submitted against the petitioner.
However, learned A.P.P. for the State submits that the petitioner has criminal antecedent, hence, opposes the prayer for bail.
Considering the facts and circumstances, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ADJ, Rosera, Samastipur in connection with Sessions Trial No. 608 of 2016 arising out of Singhia P.S. Case No. 134 of 2014, subject to the condition that the petitioner will appear before the learned Court below on each and every date and failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
