The petitioners apprehend their arrest in Gogari P.S. Case No. 172 of 2014, registered for the offences punishable under Section 385 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.

The informant has alleged that while he was harvesting his maize crops, the petitioners along with their father went there and looted the crops after assaulting the informant and others. Learned counsel for the petitioners submits that the disputed land stands in the name of Narayan Yadav the father of the petitioners as the same appear from the report of the Circle Officer Annexure-4. It is further submitted that prior to lodging of

Patna High Court Cr.Misc. No.8123 of 2015 (2) dt.02-03-2015 2/2 this case the father of the petitioners filed complaint case against the informant and his family members for looting the crops of the petitioners.

It appears that there is land dispute between the petitioners and the informant and from both sides case and counter case have been filed for looting the crops.

Considering the facts aforesaid the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Ankur Gupta, the learned Judicial Magistrate 1st Class, Khagariya in connection with Gogari P.S. Case No. 172 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
