The petitioners are apprehending their arrest in connection with Harijan P.S. Case No. 31 of 2015 for offence under Sections 323/341/379/504 of the Indian Penal Code and Section 3(X) of the SC/ST Act.
As per the allegation, the Informant is the proprietor of the Sangam Dhol Tasa Band and he has played the band in the marriage of the petitioner on 9.2.2015. There is a dispute with respect to rest payment of the agreed amount as certain amount was paid in advance to the Informant. Later on when the Informant approached to the petitioners for rest of the agreed
Patna High Court Cr.Misc. No.10054 of 2016 (2) dt.08-03-2016 amount, the Informant was abused and was also assaulted by slap and fist.
Learned counsel for the petitioners submits that the dispute between the petitioners and the Informant has already been settled outside the court as is apparent from Anenxure-2 Series of this application.
Looking to the entire facts and circumstances of this case, this Court would direct for release of the petitioners, namely, Kameshwar Singh and Vijay Singh on bail in the event they would surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Vaishali at Hajipur in connection with Harijan P.S. Case No. 31 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
