The petitioner is an accused in connection with Sarai P.S. Case No. 82 of 2016, registered under Sections 399, 402 & 414 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act, pending in the Court of Addl. Chief Judicial Magistrate-XIII, Hazipur, Vaishali.

The accusation is of recovery of one country made pistol and one live cartridge from the possession of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in this case. The petitioner is in custody since 05.07.2016. The petitioner is accused in five other cases, as detailed in para-03 of the petition.
