The petitioner seeks bail in Agamkuan P.S. case No. 1007/2019 registered u/s 30(a), 36 of the Bihar Prohibition & Excise Act.

The informant got information that illicit liquor was kept in the house of Bulli Mahto but one person was found fleeing away on Passion motor cycle. The police chased the motorcyclist and apprehended him where one another person was also started fleeing away, who was also apprehended. The apprehended accused disclosed his name as Ganesh Kumar, the petitioner. The name of motorcyclist was Shravan Kumar. The apprehended accused disclosed that they brought the liquor to the house of Bulli Mahto with his consent. 200 liters of country made liquor made of Mahua was recovered from the house of

The learned counsel for the petitioner submits that petitioner was apprehended while fleeing away but nothing has been recovered from his possession. The recovery was made from the house of Bulli Mahto. The petitioner is in custody since 09.12.2019. The petitioner has already remained in jail for about three months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna in Agamkuan P.S. case No. 1007/2019.
