The petitioner has preferred this application for grant of regular bail in a case registered under sections 394 and 302 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, it is stated by the informant that he received information that while his father was on way along with ornaments from his shop towards his home, he was shot dead by unknown accused persons.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Vivek Kumar made before the police. He is in custody since 21.10.2020 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material which has transpired in course of investigation and the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Vaishali P.S. Case no. 71 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
