JUSTICE ARUN KUMAR ORAL ORDER 16-02-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Raiyam P.S. Case No. 31 of 2016 registered under sections 8, 20(b)(ii)(A), 25 and 29 of the N.D.P.S. Act.

Allegation in brief is that the Police apprehended the petitioner on the road and recovered 25 puria of Ganja in total 136 grams.

It is submitted that petitioner was apprehended by the Police as per the case at 6:45 P.M. on 25.12.2016 but the FIR was lodged next day on 26.12.2016 without any explanation. The quantity is very small and this petitioner has got no criminal antecedent and has been in custody since he was remanded on 27.12.2016.

Patna High Court Cr.Misc. No.6668 of 2017 (2) dt.16-02-2017 Considering the said facts and circumstances, the petitioner, namely, Sukhdeo Choudhary is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Darbhanga in connection with Raiyam P.S. Case No. 31 of 2016.
