The petitioner apprehends his arrest in Excise P.S. Case No. 52 of 2021, registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2018.

72 litres of illicit liquor has been recovered from Indica car and 918 litres of foreign liquor has been recovered from one room constructed by asbestos. Thereafter, a room was searched from where 2728 litres of foreign liquor of different description was recovered.

It is submitted that nothing has been recovered from conscious possession of this petitioner. Petitioner has got no

Counsel for the State vehemently opposed the bail application and submitted that petitioner has got criminal antecedent of similar nature.

Considering the criminal antecedent of petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail.

Accordingly, the prayer for anticipatory bail is rejected.
