The petitioner is apprehending arrest in connection with Saharsa Sadar P.S. Case No. 627 of 2017 for the offences under Section 406 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation of defalcation of Rs. 39,771/- is levelled against the petitioner without verifying the fact that he has already deposited the same amount. He further submits that the defalcation alleged is relatable to the financial year 2004-05 and 2005-06, whereas the case was registered after superannuation of the petitioner in 2014.

Considering the totality of the fact, the Court is of the view that the matter relates to accounting and as such the Court

No.10897 of 2020(2) dt.03-03-2020 2/2 is inclined to grant anticipatory bail to the petitioner, in the event of arrest or surrender within one month from today, on furnishing bail bonds of Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S.
