In this case, the petitioner is apprehending his arrest in connection with Doriganj P.S. Case No. 117 of 2016 registered for offences under sections 363, 364 and 368 of the Indian Penal Code.

A complaint has been filed against the petitioner of kidnapping the son of the Informant, namely, Syed Ali. In statement made under Section 164 of the Cr.P.C., an allegation has been made against the accused persons including petitioner that he was carried by the petitioner on the threat of life, he worked in a restaurant for a few months and when he got an opportunity, he fled away.

Learned counsel for the petitioner submits that this

Patna High Court CR. MISC. No.14664 of 2019(2) dt.12-03-2019 2/2 case is a counter-blast of the case filed by the daughter-in-law of the Informant and, to settle the score, the present case has been lodged. He has further stated that the Statement made under Section 164 Cr.P.C. itself shows that the victim remained in a hotel and he was working there. He has submitted that the statement of the victim under Section 164 is tutored one. Looking to the entire facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs.

10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIIth, Saran at Chapra in connection with Doriganj P.S. Case No. 117 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
