JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/120B/34 of the Indian Penal Code.
The petitioner is not named in the F.I.R. lodged for the occurrence of murder. However, his name has transpired in the confessional statement of Md. Kaishar, the F.I.R. named accused.
Submission is that petitioner has stated on oath that he has got no criminal antecedent and is in custody since 25.02.2017.
Considering the fact that there is no direct

No.18484 of 2017 (2) dt.25-04-2017 2/2 material against the petitioner and confession of the co-accused before the police is no evidence, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/Successor Court, in connection with Jokihat P.S. Case No.204 of 2015, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
