2. The petitioners seek bail in connection with Jhajha Police Station Case No. 448 of 2024 registered for the offence under Sections 103(1), 238, 3(5) of the BNS.

3. As per the prosecution case, the allegation against the petitioners is of killing the deceased.

4. The petitioners are in custody since 7.10.2024.

5. It has been submitted by the learned counsel for the petitioners that the petitioner no. 1 is the father of the deceased and petitioner no. 2 is the brother of the deceased and the petitioner no. 1, being the informant of this case, has

Patna High Court CR. MISC. No.14429 of 2025(4) dt.23-07-2025 2/2 subsequently been made accused in this case for the killing of his son. He further submits that the petitioners are not the assailant of the deceased and the assailant of the deceased is one Sandeep Manjhi.

6. Learned APP for the State has submitted that during investigation, it has come that the murder weapon i.e. sword has been recovered on the statement of the petitioner and therefore they may not be granted bail.

7. Considering the fact that the petitioners are not the assailant of the deceased, this application is allowed.

8. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of CJM, Jamui/concerned Court below in connection with Jhajha P.S. Case No. 448 of 2024. (Sandeep Kumar, J) Vikas/- U
