JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-02-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Manjhi P.S. Case No. 340 of 2020 registered for offence punishable under sections 341, 323, 307/34 of the Indian Penal Code and section 27 of the Arms Act.

As per allegation, the accused persons were opening fire by fire arms at Chhath Ghat, whereby some persons became injured.

The learned counsel for the petitioner has submitted that there is no allegation of firing on the present petitioner. The only allegation against the petitioner is that he was standing there with the accused persons.

No.22278 of 2021(3) dt.24-02-2022 2/2 The case diary has been received, which shows that injured Girija Devi has stated that the accused Nautanki Singh @ Pranav Singh and other accused persons opened fire and made her injured. The name of the present petitioner has been figured only in the fard-beyan of Sudhir Kumar Singh and it has been mentioned that there is no allegation against the petitioner in the FIR that he made firing.

As such, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIII, Saran, Chapra in connection with Manjhi P.S. Case No. 340 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
