JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for non-fulfilment of the dowry demand.
It is submitted by learned counsel for the petitioner that subsequently the informant died due to illness for which UD case was registered by the mother of the informant. The same has been brought on record as Annexure-2 which suggests that UD Case No. 01 of 2015 was registered on 17.01.2015 where the mother of the informant has accepted that she was getting the informant
Patna High Court Cr.Misc. No.13008 of 2015 (2) dt.06-05-2015 2/2 treated at her own house and on 17.01.2015 in the morning, the informant was taken to the doctor for treatment but she died on the way.
Learned counsel for the informant submits that the petitioner used to torture the informant and due to torture inflicted the informant was residing with her parents.
Considering the nature of accusation and the fact that the informant died at her parents' house much after lodging of the present case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Saran at Chapra in connection with Rasulpur P.S. Case No. 81 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
