JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-10-2020 Supplementary affidavit has been filed for removal of the defects but the office vide its report dated 09.10.2020 reported that some defects are still stand. However, the report dated 09.10.2020 of the office be ignored.

Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioners are in custody since 23.10.2019 in connection with Andhramath P.S.Case No. 84 of 2019 registered for the offences punishable under Sections 302 and other minor

Patna High Court CR. MISC. No.20953 of 2020(5) dt.12-10-2020 2/2 sections of the Indian Penal Code and 27 of the Arms Act. Although, petitioners are named in the first information report but no specific overt act has been attributed against them and it appears that they were only member of unlawful assembly. Petitioners do not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named, petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st class, Madhubani in connection with Andhramath P.S. Case No. 84 of 2019.
