The petitioners are languishing in custody for the offences punishable under Sections 272, 273 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Huge quantity of liquor was recovered from a four wheeler. The petitioners were driver and cleaner of the said vehicle. Petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 30.12.2020. Investigation of the case is already complete. Considering the entire facts aforesaid, let the

No.22479 of 2021(2) dt.02-09-2021 2/2 petitioners, above named, be released on bail, after framing of the charges so that trial may not hamper, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Special Excise Case No. 638 of 2020 arising out of Dagarua P.S. Case No. 246 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
