JUSTICE PARTHA SARTHY ORAL ORDER 01-06-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Udwant Nagar P.S. Case No. 373 of 2019 registered under sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per allegation in the FIR, on secret information having been received, checking of the vehicle was started by the informant. Scorpio vehicle of the accused persons made an attempt to escape but was apprehended by the police personnel. On search, a cartridge was recovered from the pocket of the petitioner while a loaded pistol and a cartridge was recovered from the vehicle, which was occupied by the four accused persons including the petitioner herein.

No.15257 of 2020(3) dt.01-06-2020 2/2 It is submitted by learned counsel for the petitioner that the allegation of recovery is false and no incriminating article has been recovered from the possession of the petitioner. The petitioner is in custody since 20.9.2019. The application for bail is opposed by the learned APP for the State.

Having heard the learned counsel for the parties and taking into consideration the facts of the case including the petitioner being in custody for more than eight months since 20.9.2019, the court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Udwant Nagar P.S. Case No. 373 of 2019 on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara.
