The petitioner is accused in connection with NDPS Case No. 56 of 2016 (Chhatauni P.S. Case No. 216 of 2016), registered under Sections 399, 402 and 120(B)/34 of the Indian Penal Code and Section 20(B), 22 of the NDPS Act. The accusation is that Police received secret information that some miscreants are making plan to commit crime at the Bank of Pond (Man) situated in mohalla Bhawanipur Zirat. Thereafter, Police personnel reached there. On seeing the Police party, some persons started fleeing, out of them five persons, including the petitioner, were apprehended. On search, 200 grm ganja was recovered from the possession of
Patna High Court Cr.Misc. No.7372 of 2017 (2) dt.09-03-2017 2/2 the petitioner, while others were found arms and ammunitions. Learned counsel for the petitioner submits that petitioner is in custody since 06.09.2016. Further submission is that petitioner is accused in Chhatuni P.S. Case No. 217 of 2016, which has been instituted regarding recovery of arms and ammunitions from the other accused. The petitioner is in custody since 06.09.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge/Special Judge, East champaran, Motihari in connection with NDPS Case No. 56 of 2016 (Chhatauni P.S. Case No. 216 of 2016).
