2. The petitioner has prayed for bail in Beldaur P.S. Case No. 251 of 2024 registered for the offence punishable under sections 126(2), 115(2), 109, 303(2), 352, 351(2), 351 (3), 3(5) of the B.N.S. Act and Section 27 of the Arms Act.
3. As per allegation in the FIR, while the informant was returning to his house at 9 P.M. on 15.07.2024, in the way, FIR named accused persons including the petitioner stopped him and on order of Pappu Yadav, accused persons opened fire and he fell down. Patna High Court CR. MISC. No.11891 of 2025(3) dt.12-05-2025 2/3 of butt of pistol as a result of which he received injury on his left leg and eye. On hulla being raised by the informant, villagers gathered there then accused persons fled away.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to dirty village politics. General and omnibus allegation has been levelled against the petitioner. During course of investigation, no independent witness has supported the prosecution version. After completion of investigation, charge-sheet has been submitted against the petitioner u/s 115(2), 353, 351(2), 3(5) of the B.N.S and Section 27 of the Arms Act.. I.O. has not found the case true u/s 109 of the B.N.S. 'Attempt to Murder'. Petitioner is languishing in judicial custody since 13.09.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only)
