JUSTICE BIRENDRA KUMAR ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code as well as Sections 30, 38 and 41 of the Bihar Excise Act. The police seized 15 litres of country made liquor and the petitioner and other co-accused, namely, Binod Mahto were seen fleeing away from the place of occurrence. Binod Mahto has already been allowed bail by a Co-ordinate Bench of this Court vide order dated 07.02.2017 passed in Cr. Misc. No. 5569 of 2017. Petitioner is in custody since 27.12.2016 and has stated on oath that he has got no criminal antecedent.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.9070 of 2017 (2) dt.01-03-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra/successor Court in connection with Chapra Muffasil Police Station Case No. 422 of 2016.
