Mr. Ranjan Srivastava, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 13-10-2020 Heard learned counsel appearing for the respective parties through Virtual Court Proceeding.

In this case, the petitioners are seeking anticipatory bail in connection with Saharsa Sadar P.S. Case No.1081 of 2018, registered for the offence under Sections 406, 409 and 420/34 of the Indian Penal Code.

Allegation has been made against four persons including this petitioner to have defalcated 937.44 quintals of rice, which is valued at Rs.21,68,450/- Learned counsel for the petitioner submits that the petitioner is ready to deposit 25% amount of Rs.21,68,450/- in

Patna High Court CR. MISC. No.13964 of 2020(7) dt.13-10-2020 2/2 four equal installments.

Considering the aforesaid fact, let the above-named petitioner, be released on provisional bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar P.S. Case No. 1081 of 2018 subject to the condition that the petitioner would fully cooperate with the trial of the case, failing which, the Court below shall be at liberty to cancel the bail bond of the petitioner. This is also subject to the condition that the petitioner would deposit 25% amount of Rs.21,68,450/- in four equal installments and will deposit first installment within 15 days from the date of his release and rest three installment will be deposited within a period of six months thereafter.

In failure to deposit the aforesaid amount within the aforesaid period, as stated hereinabove, this order will be treated to have been cancelled. If the petitioner deposits the amount, as has been stated hereinabove, then his provisional bail will be confirmed.
