====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-04-2025 Heard the learned counsel for the petitioner and learned APP for the State.

2. Petitioner apprehends arrest for the offences alleged under Sections 41 & 42 of the Indian Forest Act and Sections 5, 8, 9, 10, 12, 13 and 14 of the Wild Life Protection Act, registered in connection with Forest Case No. 47F of 2024.

3. As per the prosecution case, on a secret information that the petitioner along with other accused persons have established an illegal saw mill and are operating the same, Forest Officer along with other forest officials, raided the spot and seized saw machines with other related tools.

4. Learned counsel for the petitioner has submitted that the petitioner is merely a labourer and not owner of the saw mill. He has been dragged in this case due to village politics.

Patna High Court CR. MISC. No.13043 of 2025(2) dt.08-04-2025 2/2 Co-accused, with similar allegation, have already been allowed pre-arrest bail by different co-ordinate benches of this Court vide order passed in Cr.Mis.No.68925/2024 and 69178/2024. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IV, Bettiah, West Champaran in Forest Case No. 47F/2024, subject to the conditions as laid down under Section 438(2) Cr.
