Heard learned counsel for the petitioners, learned APP for the State as well as learned counsel appearing on behalf of the informant.

Petitioners apprehend their arrest in connection with Wazirganj P.S. Case No.152 of 2022, registered for the offences punishable under Sections 341, 323, 324, 307, 379, 354, 504 and 34 of the Indian Penal Code.

The petitioners are said to have assaulted the informant side by means of different weapons. The accused persons also snatched ornaments from the informant side. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners of Cr. Misc. No.68550 of 2022 have got one criminal antecedent and petitioner of Cr. Misc. No.12171 of 2023 has got in criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that there is case and counter case between the parties and both sides sustained injuries. Learned counsel for the petitioners submits that the injuries sustained by the injured persons are simple in nature (Annexure-3 series).

Taking into consideration the facts that the injuries sustained by the injured persons are simple in nature, both sides are agnates and title suit is also pedning between the sides, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Gaya in connection with Wazirganj P.S.
