JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 147, 148, 149, 323, 307, 504, 448, 379, 354, 337, 428/ 506 of the Indian Penal Code. The prosecution case is that on 14.11.2015 at 11 PM the informant came for immersing idol of goddess Laxmi then his covillagers, Deepak Kumar, Sonu Kumar, Raja Kumar, Sajani Ravidas, Munchun Ram, Sonu Kumar, Pintu Kumar and petitioner along with 10-15 persons assaulted the informant. Co-accused Deepak Kumar assaulted the informant with iron rod on his head. It is alleged that petitioner assaulted Gunjan Kumar, Akhilesh Kumar and Dhananjay Kumar with iron rod. Co-accused Deepak Kumar took out mobile phone and golden chain of the informant

Patna High Court Cr.Misc. No.9023 of 2016 (2) dt.26-02-2016 2/2 and petitioner took out mobile phone of Ranjeet Kumar, brother of the informant, and thereafter all the accused persons escaped from the scene.

It is submitted by the learned counsel for the petitioner that for a petty dispute the accusation has been levelled. The injury of Gunjan Kumar has been found to be simple in nature. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Hare Ram, learned JM, 1st class, Masaurhi, Patna in connection with Punpun P.S. Case No. 265 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
