JUSTICE BIRENDRA KUMAR ORAL ORDER 24-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner is languishing in custody for the offences punishable under Sections 341, 323, 324, 325, 326, 307, 302, 504 and 506/34 of the Indian Penal Code.
There is no allegation against the petitioner to have assaulted to the deceased. However, allegation is to have caused injury to some other persons. Similarly situated co-accused Deepak Kumar has already been allowed bail by this Court in Cr.Misc.No.9071 of 2017.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.8967 of 2017 (5) dt.24-04-2017 satisfaction of learned Sub-Divisional Judicial Magistrate (West), Muzaffarpur/Successor Court, in connection with Karja P.S. Case No.85 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
