The petitioners are seeking anticipatory bail in connection with Riga P.S. Case No. 326/2018 registered under Sections 147/148/149/341/342/323/307/332/333/353/337/338/ 427 / 120(B) /504/506 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are named among the 15 accused persons against whom there are general and omnibus allegation that they had blocked the road and had created the disturbance in free

Patna High Court CR. MISC. No.10960 of 2019(2) dt.26-02-2019 2/3 movement of the vehicles as also that they had interfered with the police authority in discharging their official duties. Learned counsel submits that similarly situated named accused persons have been granted privilege of anticipatory bail by a learned coordinate Bench of this court in Cr. Misc. No. 8026/2019. Learned A.P.P. for the State is present and has opposed the prayer for anticipatory bail of the petitioner, howver it is not disputed that these petitioners are similarly situated with those who have been granted privilege of anticipatory bail by learned coordinate Bench of this Court.

In the aforesaid view of the matter, considering that some similarly situated persons have been granted privilege of anticipatory bail, in order to maintain uniformity in justice, this court extends the same benefit to these petitioners, in the event of their arrest/surrender before the court below within a period of four weeks, let the above-named petitioners be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No. 326/2018, subject to condition that petitioners will present themselves before the Investigating Officer within a period of two weeks

Patna High Court CR. MISC. No.10960 of 2019(2) dt.26-02-2019 3/3 from today in interrogation and shall cooperate in course of investigation of the case. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
