JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-04-2023 Though the present writ petition has been filed for quashing the entire proceeding of Encroachment Case No. 9 of 2022-23, initiated by the Circle Officer, Andhara Thadhi, however it is submitted by the learned counsel for the petitioner that Circle Officer, Andhara Thadhi has already passed the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, on 30.11.2022, in connection with Encroachment Case
Patna High Court CWJC No.4209 of 2023(2) dt.05-04-2023 2/2 No. 9 of 2022-23, whereafter the petitioner has filed an appeal before the District Magistrate, Madhubani and the same is still pending, hence the same be directed to be disposed of expeditiously.
Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the District Magistrate, Madhubani to dispose of the encroachment appeal filed by the petitioner, in case the same has been filed and is still pending, by passing a reasoned and a speaking order, in accordance with law, within a period of four weeks of receipt/ production of a copy of this order.
The writ petition stands disposed of on the aforesaid terms.
