JUSTICE SANDEEP KUMAR ORAL ORDER 13-05-2025 Heard the learned counsel for the petitioner, learned counsel for the State and the learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Cyber Saharsa P.S. Case No. 54 of 2024 registered for the offence under Sections 75, 79, 108 of the Bharatiya Nyaya Sanhita, 2023 and Sections 8/12 of the POCSO Act and Sections 66, 66E and 67 of the IT Act.

3. As per the prosecution case, the petitioner and others uploaded the videos of three girls with a Bhojpuri song because of which three girls tried to commit suicide by consuming poison.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.13002 of 2025(3) dt.13-05-2025 2/3 petitioner is innocent and has not committed any offence. Petitioner is in custody since 17.10.2024 and claims clean antecedent.

5. Learned counsel for the informant has vehemently opposed the prayer for bail by submitting that the petitioner and two others were teasing the girls from before and they have done this act which forced the girls to take poison.

6. Considering the facts and circumstances of the case as well as the period of custody, this application for regular bail is allowed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO Act, Saharsa/concerned Court below in connection with Cyber Saharsa P.S. Case No. 54 of 2024 subject to condition that:- (i). The petitioner will give an undertaking before the Court below that he will not stay within the jurisdiction of Saharsa District. He will only visit the District Saharsa on the dates fixed in the case.

(ii). In case the petitioner violates the terms of the bail as stated above, the SHO of Patarghat Police Station will move before the Court for cancellation of the bail of the petitioner.
