JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-07-2021 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of COVID-19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner, the learned counsel appearing for the respondent- University as also the learned counsel for the State.

The writ petition has been filed for directing the respondents to make payment of the retiral dues under the head

Patna High Court CWJC No.24981 of 2018(5) dt.02-07-2021 2/3 leave encashment, Gratuity, Group Insurance, D.D.A., Pension and Arrears of Salary.

The learned counsel for the petitioner submits that except the amount of Group Insurance and deferred D.A., the rest of the retiral dues have stood paid to the petitioner. It has also been submitted that pay point of the petitioner's pay scale is yet to be fixed, inasmuch as details are yet to be received from the Pay Verification Cell, Patna.

The learned counsel for the University has not disputed the aforesaid position, as is existing on facts. Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose of the present writ petition with a direction to the Vice Chancellor, Lalit Narayan Mithila University, Darbhanga to forthwith pay the aforesaid outstanding amount pertaining to Group Insurance and deferred D.A. to the petitioner as also make endeavours to get the pay point of the pay scale of the petitioner fixed, who is stated to have retired as lecturer on 30.06.2015.

It is needless to state that the petitioner shall be at liberty to seek redressal of his aforesaid grievances by approaching the Vice Chancellor, Lalit Narayan Mithila

Patna High Court CWJC No.24981 of 2018(5) dt.02-07-2021 3/3 University, Darbhanga. It is also directed that the outstanding payments, as aforesaid should be made to the petitioner within a period of 06 weeks of receipt/ production of a copy of this order. The writ petition stands disposed of on the aforesaid terms.
