JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-03-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sonbarsa Raj P.S. Case No. 151 of 2017 for the offenses under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner admits that though the petitioner has criminal antecedent but he has been made accused all the cases only on suspicion. The petitioner is in custody since 18.07.2018. He submits that in a case against unknown it is obligatory on the part of the prosecution to identify the accused but the petitioner has not been put on Test Identification Parade. In the circumstances the petitioner deserves bail.

Considering the fact that the petitioner has remained

Patna High Court CR. MISC. No.16005 of 2019(2) dt.14-03-2019 2/2 in custody for nearly 7 years and he has not been put on TIP and the name of the petitioner surfaced on the confessional statement, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Sonbarsa Raj P.S. Case No. 151 of 2017.
