The petitioner seeks bail in Madhepura P.S. Case No. 63 of 2021, registered for the offence punishable under Section 395 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, while the informant was sitting in his shop, six unknown miscreants riding on two motorcycle came there and on the point of gun snatched the key of cash box and looted cash of Rs. 4,50,000/- and fled away. It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of this petitioner surfaced in this case on the basis of confessional statement of co-accused Prince Kumar and Jhunkilal Yadav. No looted article has been recovered from possession of this petitioner. Petitioner has not been put on test identification parade till date. Petitioner

Considering lack of sufficient material against the petitioner for further detention, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Madhepura in connection with Madhepura P.S. Case No. 63 of 2021.
