1. Learned counsel for the petitioners at the outset seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 1, namely, Naresh Yadav @ Sidaka who was arrested during pendency of the anticipatory bail application.
2. Permission is accorded.
3. Accordingly, the anticipatory bail application with
Patna High Court CR. MISC. No.16706 of 2025(2) dt.16-04-2025 2/3 respect to petitioner no. 1 is dismissed as withdrawn.
4. Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.
5. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 34 and 506 of the Indian Penal Code.
6. Learned counsel for the petitioners submits that petitioners no. 2, 3, 4 and 5 have antecedent of one case and petitioner no. 6 is a person with clean antecedent. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that on asking the reason for giving threat to shoot her brother an altercation had taken place in between the side of the informant and the petitioners in which the side of the accused assaulted the side of the informant. It is next submitted that allegation of assault is general and omnibus in nature. It is also submitted that Ganesh Yadav along with four others had moved this Court seeking anticipatory bail by filing Cr. Misc. No. 84237 of 2024 and the same was allowed by an order dated 19.12.2024 passed by a learned Coordinate Bench of this Court.
7. Learned A.P.P. for the State and learned counsel
Patna High Court CR. MISC. No.16706 of 2025(2) dt.16-04-2025 3/3 appearing on behalf of the informant opposed the prayer for anticipatory bail of the petitioners.
8. Considering the submissions made by the learned counsel for the petitioners no. 2, 3, 4, 5 and 6, let the petitioners no. 2, 3, 4, 5 and 6 above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Buniyadganj P.S. Case No. 148 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
