====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-03-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 341, 323, 307, 354, 427, 147, 149, 504, 506, 34 of the Indian Penal Code.

3. As per the prosecution case, when the informant was returning home from the field, all the FIR named accused persons including these petitioners surrounded her. Thereafter, petitioner no.2 caught her hair, co-accused Sujit Kumar hurled Garasa blow, co-accused Sonu Kumar hurled iron rod blow and when her husband came to rescue, co-accused Sanjay Mahto assaulted him by Kudal. Accused persons also assaulted informant's mother-in-law and her sons.

4. It is submitted on behalf of the petitioners that

Patna High Court CR. MISC. No.10894 of 2025(2) dt.07-03-2025 2/2 parties are gotia and there is land dispute between them. It is further submitted that due to petty dispute, marpit took place between the parties in which both sides sustained injuries. There is case and counter case. injuries caused by these petitioners were simple in nature.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in Jagdishpur Police Station Case No. 127 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
