The petitioner apprehends his arrest in Powakhali P.S. case No. 58 of 2018 registered under Section 307 and other Sections of the Indian Penal Code.

The informant alleged that petitioner inflicted repeated dagger blow on his cousin, Juber Alam, who was taken to Sadar Hospital from where he was referred to MGM, Kishanganj. The doctor of MGM referred Juber Alam to Siliguri for better treatment.

The learned counsel for the petitioner submits that informant is not an eye witness of the occurrence but from perusal of the order of learned Sessions Judge it appears that it was the petitioner who inflicted repeated dagger blow on different parts of body of Juber Alam and he received grievous

Considering the facts aforesaid and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
