JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-09-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of Vigilance P.S. Case No. 109 of 2015, disclosing offences under Sections 420, 467, 468, 477A, 192, 201 and 120B of the Indian Penal Code and Section 13(2) read with 13(1) (d) of he Prevention of Corruption Act.

The petitioners are working as Panchayat Teachers under Eksara Panchayat of Ben Block in the district of Nalanda.

Patna High Court Cr.Misc. No.40742 of 2016 (2) dt.22-09-2016 2/3 The Vigilance Bureau has registered the case on the basis of direction issued by this Court in a batch of writ applications which has been mentioned in the First Information Report itself. The main allegation is of making selections and appointments against the post of Panchayat Teachers without following due procedure prescribed.

Learned counsel appearing on behalf of the petitioners has submitted that there is no specific allegation of any misrepresentation or fraud committed by these petitioners in the First Information Report leading to their selection. It has lastly been submitted that in any event there is no chance that they will fleeing from course of investigation or trial. Considering the nature of allegation and the submissions advanced on behalf of the petitioners, this application is allowed.

Let the petitioners, above-named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance 1st, Patna in connection with Vigilance P.S. Case No. 109 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
