Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B),201 and 120(B) of the Indian Penal Code.

Petitioner is in custody since 19.07.2017.

Earlier prayer was refused on 13.02.2018 in Cr.Misc.No.57451 of 2017 considering the allegation against the petitioner that he committed death of his wife for non-fulfilment of dowry demand. The learned Trial Court was directed to expedite and conclude the trial within nine months without allowing any unnecessary adjournments to any of the parties.

Patna High Court CR. MISC. No.14243 of 2019(2) dt.24-04-2019 2/2 The impugned order reveals that the trial has not concluded as yet in spite of framing of the charges on 05.10.2018.

The prayer for bail is on the ground of period of custody as well as submission that during investigation several independent witnesses stated before the police that the victim died of snake bite.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T.No.336 of 2018 arising out of Jankinagar Police Station Case No.109 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
