JUSTICE ARUN KUMAR ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Beur P.S. Case No.248 of 2016 registered under Sections 420, 406, 467, 468, 471 and 120(B)/34 of the Indian Penal Code. Allegation in brief is that the informant was enrolled in Bachelor in Opthal. course in the Institute run by a trust of which the petitioner is Managing Director and for the last three years, examination is not being held and at the time of admission, Rs.83,000/- was charged but receipt of only Rs.40,000/- was given. Earlier this petitioner had moved for bail before this Court, which was rejected by order dated 8.3.2017 with an observation to renew his prayer for bail after framing of charge. Patna High Court Cr.Misc. No.15495 of 2017 (2) dt.12-04-2017 2/2 submits that now the investigation is complete, thereafter, charge has been framed by order dated 18th March, 2017 and this petitioner has been in custody since 21st September, 2016. Having considered the said facts and circumstances, the petitioner, namely, Anil Sulabh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rahul Kumar, Judicial Magistrate, Ist Class, Patna in connection with Beur P.S. Case No.248 of 2016.
