JUSTICE JYOTI SARAN ORAL ORDER 02-12-2016 Heard Mr. Rakesh Chandra and Mr. Ashok Kumar Pathak, Assisting Counsel to G.P.-21 for the State. In the nature of the relief so prayed in the writ petition, it would not require to await filing of the counter affidavit.

The petitioner prays for appropriate directions to the concerned respondent authorities of the Registration Department for passing appropriate orders on the sale deed presented for registration dated 08.1.2016 together with the requisite fees, a copy of which is enclosed at Annexure-2 to the writ petition. According to the petitioner, the matter remains pending before the District Sub Registrar, Khagaria for disposal since 08.1.2016.

Patna High Court CWJC No.3287 of 2016 (2) dt.02-12-2016 Having heard learned counsel for the parties and considering the nature of relief prayed herein, I deem it fit and proper to direct the District Sub Registrar, Khagaria to consider the grievance of the petitioner regarding non registration of the sale deed pending since 08.1.2016 and dispose of the same accordingly within a period of four weeks from the date of receipt/production of a copy of order.

It goes without saying that in case the District Sub Registrar has reservation about the registration of the sale deed in question, he shall dispose of the matter by a speaking order to be passed after opportunity of hearing to the petitioner.
