The petitioner seeks bail in connection with Suiya P.S. Case No.11 of 2019 registered under Sections 399 and 402 of the Indian Penal Code besides Sections 25(1-b) a, 26(i) and 35 of the Arms Act.
The accusation is that on receiving the secret information about gathering and making plan to commit heinous crime by Md. Naushad Alam of village-Chihatjore along with his associates, the informant along with other police personnel proceeded for villageChihatjore and reached at the house of Md. Naushad Alam. On seeing the police party, one person started to flee away from there, however, on chase, he was apprehended, who disclosed his name as Naushad Alam. On search, he was found in possession of one loaded
Patna High Court CR. MISC. No.9991 of 2020(2) dt.29-02-2020 2/2 country pistol and, on query, he disclosed that he along with his associates, namely, Khameer, Maksood (petitioner), Santosh and Sameer used to commit road dacoity and loot.
Learned counsel appearing on behalf of the petitioner submits that the petitioner was not apprehended on the spot rather his name has surfaced in the confessional statement of Naushad Alam, who was apprehended with one loaded country made pistol. Further submission is that since the petitioner is accused in two other cases, as detailed in paragraph-3 to this application, due to that reason, the petitioner has falsely been implicated in this case. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate,-I, Banka, in connection with Suiya P.S. Case No.11 of 2019. Out of the two sureties, one must be the close relative of the petitioner.
