2. The petitioner seeks regular bail in connection with Bairiya P.S. Case No. 196 of 2025 registered for the offence under Sections 103(1) and 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and others are accused of killing the deceased by stabbing him.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. The petitioner is in custody since 13.10.2025. He further submits that during the investigation, blood stain clothes have been recovered from the co-accused Sahbaz Khan. He further submits that the informant is not an eye witness to the occurrence and the informant was in Kerala at the time of occurrence.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bettiah, West Champaran/concerned Court below in connection with Bairiya P.S. Case No. 196 of 2025 subject to condition that:- (i). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and noncooperation in the trial shall result in cancellation of the bail bond of the petitioner.
