JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-04-2015 Heard learned counsels for the petitioners and the State. The petitioners being the mother, grand-mother, brother's wife, cousin, elder brother and uncles of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 302 and 494/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after twelve years of the marriage and performing second marriage by the husband of the victim. It is submitted by learned counsel for the petitioners that the victim was residing with her husband at Chandigarh and due to
Patna High Court Cr.Misc. No.13188 of 2015 (2) dt.02-04-2015 2/2 the husband of the victim performed second marriage, the victim committed suicide. It is further submitted that since the informant did not support the accusation, other co-accused Daroga Rai and Shyam Kumar have been acquitted vide S. Tr. No. 586 of 2014, a certified copy of the same has been produced, let it be kept on record.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran in connection with Taraiya P.S. Case No. 60 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
