The petitioner apprehends his arrest in Katihar Town P.S. Case No. 427 of 2013, registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. A dacoity was committed in the jewellery shop.

It is submitted that the petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. Name of the petitioner has not figured in the confessional statement of co-accused. Only Dy. S.P. suspected the involvement of the petitioner. Considering the facts aforesaid and the fact that the Dy. S.P. suspected the hands of the petitioner in the dacoity, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
