The petitioner seeks bail in connection with Siwan Rail P.S. Case No. 83 of 2016 registered under Section 30(a) of the Bihar Prohibition & Excise Act 2016.
In short, the allegation is that while the informant was on patrolling duty along with his officials, he apprehended this petitioner with 37 bottles containing 200 ml. of U.P. made english wine.
Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. The petitioner is in custody since 11.12.2016 having no criminal antecedent. There is no substantive evidence to suggest his implication in the present case.
Patna High Court Cr.Misc. No.6038 of 2017 (2) dt.01-03-2017 2/2 Learned APP, on the other hand, opposed the prayer. Considering the facts and circumstances of the case, his prayer of bail is allowed. The petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional C.J.M. (Railway) Sonepur at Saran in connection with Siwan Rail P.S. Case No. 83 of 2016.
