In this case, the petitioner is seeking anticipatory bail in connection with Minapur P.S. Case No. 390 of 2017, registered for the offence punishable under Sections 399, 402, 412 and 414 of the Indian Penal Code, Sections 25(1-b) A/26/35 of the Arms Act and Section 3/4 of the Explosive Substance Act. Allegation has been made that the police has raided the house of Chandra Dev Sahni and huge number of arms has been recovered and after seeing the police party, the accused persons fled away. The petitioner has also got criminal antecedent.

Looking to the nature of allegation, this Court is

Patna High Court CR. MISC. No.16818 of 2019(2) dt.26-03-2019 2/2 not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
