The petitioner seeks bail in a case instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 30 (A) of Excise (Amendment) Act, 2016. It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.09.2016. He has got no criminal antecedent.
It is alleged that on confidential information, the police party reached in the field of one Satish Dubey, from where two persons tried to run away. The petitioner was apprehended and 15 liters of illicit country made liquor was recovered, which was kept in a plastic jerking at the place of occurrence.

No.3712 of 2017 (2) dt.09-02-2017 2/2 From perusal of the seizure list, which is enclosed with the F.I.R, it appears that the aforesaid country made liquor has been recovered from the field of one Satish Dubey. The petitioner is in custody since 14.11.2016. The petitioner has got no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran, in connection with Muffasil (Lakhaura) P.S. Case No. 422 of 2016.
