JUSTICE MADHURESH PRASAD ORAL ORDER 24-04-2019 It is submitted by counsel for the petitioners that issue regarding grant of pay scale of Rs 4000/- to 6000/- as claimed by the petitioners has been settled by order of the Division bench in the proceeding out of LPA no. 167 of 2016 decided on 23.6.2017. He submits that same also takes care of
Patna High Court CWJC No.3479 of 2016(2) dt.24-04-2019 2/2 the benefit to be granted and also with regard to arrears in the scale of Rs 4000/- to 6000/-.
It is submitted that relying upon the said decision, petitioners would be approaching respondent no.2 (District Magistrate, Siwan) by filing a comprehensive representation claiming benefit of the scale of Rs 4000/- to 6000/- as well as arrears in terms of order passed by Division Bench in LPA no. 167 of 2016 within four weeks.
Without expressing any opinion on the merit of the case, writ petition is disposed off in view of submissions made by counsel for the petitioners.
It is needless to say that if a representation is filed within four weeks, District Magistrate, Siwan will be under obligation to consider the claim of the petitioners and pay dues to them within eight weeks thereafter.
