The petitioner seeks bail in connection with Nalanda P.S. Case No. 20 of 2019, registered under Section 396 of the Indian Penal Code.

Submission is that it would appear from the first information report that the petitioner is not named in the first information report as on the basis of the fardbeyan of Santosh Kumar against unknown. In course of investigation, the police got recorded the confessional statement of Dharmraj Kumar, apprehended in connection with Nalanda P.S. Case No. 24 of 2019, who confessed his guilt showing his involvement of his associates, including the petitioner, in the present case. Except the confessional statement, nothing has been collected by the informant showing the involvement of the petitioner. The

Patna High Court CR. MISC. No.9893 of 2020(2) dt.29-02-2020 2/2 petitioner is in custody since 01.12.2019. Further, submission is that the petitioner is accused in Nalanda P.S. Case No. 14 of 2019, in which he is on bail, due to that reason, the police has implicated the petitioner showing the involvement of the petitioner in this case.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nalanda P.S. Case No. 20 of 2019 to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif.
