The petitioner apprehends his arrest in Risiyap P.S. Case No. 04 of 2019, registered for the offences punishable under Sections 420, 406 and 34 of the Indian Penal Code. Prosecution case in brief is that the complainant paid a sum of Rs. 22,50,000/- to the accused persons including petitioner for providing electric equipments, but the same was not delivered and thus committed fraud with the complainant. It is submitted that petitioner does not know the complainant and never approached him for any business deal. Petitioner has been falsely implicated in this case due to business rivalry to extort illegal money. Petitioner claims clean antecedent.

Patna High Court CR. MISC. No.22626 of 2021(7) dt.08-12-2022 2/2 Counsel for complainant opposed the prayer for bail and submitted that petitioner along with others cheated the complainant and after getting the alleged amount they did not supply the electric equipments.

Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
